■: The appellant and defendant below, J. M. Pinson, -:was indorser of a note for $500.00 executed by W. P. T. ■Warney to appellee and plaintiff below, John A. Murphy. An action was brought on the note in Pike circuit court against Varney and Pinson to recover judgment against them for its amount, interest, and costs. They failed to-answer and default judgment was rendered against them in accordance with the prayer of the petition.
