This is an action of replevin begun in August, 1889, in the Circuit Court of Rock Island County by the appellee, C. Aultman & Co., a company incorporated under the laws of Ohio, to recover the possession of certain personal property from the. appellant, the defendant below, who was the sheriff of the county. The defense was, that the property belonged to James M. Davis, and that the defendant took the' same, as sheriff, under an execution issued against Davis in favor of Elliott & Carpenter.
