MONROE, J.

Plaintiff sues for damages for the death of her son, Lum Blackburn, lately a brakeman in defendant’s employ, who died from injuries received whilst in the discharge of his duties, as plaintiff alleges, through defendant’s negligence. Defendant filed an exception, with its answer, to the effect that the petition failed to negative the existence of a widow and children, which exception was .taken under advisement, and thereafter, with leave of the court, before action on the exception, the petition was amended by supplying the required allegation, whereupon the…
