The facts in this case ,are substantially as follows: Between St. Paul and .Minneapolis defendant Chicago, St. Paul, Minneapolis & Omaha Railway Company uses in the operation of its trains two parallel tracks belonging to the defendant Great Northern Railway Company; the right being secured by a lease or traffic arrangement with the latter company. These particular tracks are used exclusively in the passenger train service, and trains moving over the same are controlled by the block signal system.
