The plaintiff, Andrew C. Paulsen, brought suit against the defendant, McAvoy Brewing Company, to recover damages for personal injuries sustained by the plaintiff on August 27, 1916, when he was struck by a team and wagon belonging to the defendant, at the intersection of Randolph street and Wabash avenue in the City of Chicago. A trial was had and a verdict rendered in favor of the plaintiff in the sum of $5,000. From a judgment entered upon that verdict the defendant prosecuted an appeal to this court.
