The Mayor and City Council of Baltimore acquired by condemnation and purchase the right to use, as part of its water supply, the water of the Gunpowder River, above Loch Raven, in Baltimore County, at which point a large dam and lake were constructed. The plaintiff is a riparian proprietor on the Gunpowder River below the dam.
