Plaintiff appeals from the order sustaining a demurrer to the complaint.

It is alleged that the city, on April 22, 1936, duly advertised for sealed bids for constructing cement sidewalks, driveways, curbing, and street crossings for the season of 1936, the bids to state the price per yard for the different kinds; that plaintiff’s bid therefor was accepted and a contract entered into between plaintiff and de fendant under which, for specified prices per square yard for sidewalks, driveway crossings and street crossings, relaying block or tile sidewalks, and 50 cents per lineal…
