WARRINGTON, Circuit Judge.
[1] Suit was brought in the Lee county circuit court of Kentucky, and removed to the court below, where defendant in error (called herein “plaintiff”) recovered a verdict and judgment against plaintiff in error (referred to herein as “defendant”), and error is prosecuted. The action was for wrongful death of plaintiff’s decedent and was heard and disposed of upon issues of alleged negligence and contributory negligence.
