This is a petition for writ of mandamus to Judge Jack D. Carl of the Jefferson County Circuit Court. The petitioner, Lucy A. Jones, asks this court to require Judge Carl to grant a trial by struck jury in the action filed by her in the circuit court.

The case arose out of the settlement of the estate of Lucy Jones's aunt, Minnie Jones Marsh, who died in 1968 while residing in Jefferson County. At the time of her death Marsh owned an undivided one-fourth interest in 300 acres of land in Marengo County.
