(after stating the facts). Counsel for the defendant seek to uphold the judgment upon the theory of our casejs where it is held that a director or other fiduciary officer of a corporation may be entitled to compensation under an implied contract where services clearly outside of liis ordinary duty as such director or officer are performed under circumstances authorizing an inference that he was to be paid therefor.
