OPINION AND ORDER
SWAIN, District Judge.
Plaintiff Montefiore Medical Center (“Plaintiff’) brings this action seeking re covery under a first-party property insurance policy for the costs of stabilizing and repairing faulty construction of the brick facade of an apartment building located at 3450 Wayne Avenue in the Bronx, New York (the “Building”). The Building was insured by Defendant American Protection Insurance Co. (“Defendant”) under Policy No. 3ZG007942-00 (the “Policy”), which was in effect from November 1, 1997 to November 1, 1998. Plaintiff is the owner of the Building.
