CUSHMAN, District Judge.
This cause is before the court upon defendant’s petition for a new trial. The plaintiff, a Kentucky seed *337dealer, sued to recover $3,024 for a shipment of Kentucky blue grass seed sold the defendant, a large seed dealer of Seattle, Wash. The contract is evidenced by certain letters and telegrams between the parties. These are set out in the former opinions in this case of the Circuit Court and the Circuit Court of Appeals. (C.
