Plaintiff-appellant State of Indiana appeals from an adverse summary judgment rendered in its suit against defendant-ap-pellee American Motorists Insurance Company (American) on a performance bond. By the terms of the bond, American had ensured the performance of Spectra Systems (Spectra) with regard to its sale and installation of an air quality monitoring system ordered by the State Board of Health.
