On the 10th day of October, 1924, Phil Rosenburg filed in the Circuit Court of Seminole County, Florida, his bill of complaint seeking to foreclose a certain mortgage given by J. C. Grimsley and Susie Grimsley, his wife, to secure the payment of a promissory note for $1,850.00 which was due June 29th, 1924. It appears that subsequent to the execution of the note and mortgage and prior to the institution of the suit the mortgagee, J. C. Grimsley, died. Complainants in the bill of complaint alleged that there was no personal estate out of which the debts of J. C. Grimsley could be paid,…
