On the 6th day of May, 1939, an alternative writ of mandamus issued out of the Circuit Court of St. Lucie County, Florida, on a petition in the name of the State of Florida, upon the relation of E. R. Pierce, as Tax Assessor of St. Lucie County, Florida, against the Board of Commissioners of the Fort Pierce Port District, the respondents. The parties in this opinion will be referred to as relator and respondents as they appeared in the lower court.
