The defendant was convicted of manslaughter in the second degree. The charge upon which he was tried was that between three and four o’clock on the morning of January 1, 1932, he had stabbed his wife with a bread knife in an apartment which they occupied in the city of New York. The wound which resulted in the death of the decedent was about an inch wide, about six inches deep and had completely severed the femoral artery, a large artery in the leg.
