BROWN, Justice.

The tragedy portrayed in the trial oi the case in hand, resulting in the conviction of the appellant John Burgess of the offense of murder, occurred about midnight July 13, 1950, in a community in the southwestern section of Cullman County which its inhabitants have dubbed “Bug-Tussle”. One of the characters involved in the tragedy was Tom Payne, a farmer twice married and twice a widower, a man in his late sixties.
