The record reflects the following circumstances out of which this case arises.
On the night of February 9, 1957, the sheriff of Pottawatomie County accompanied by four deputies were making rou*980tine checks on this Saturday night. They visited several places prior to going to defendant's home. The officer stated they had noticed traffic coming to and from the vicinity of the defendant’s premises.
