Appellant Tammy Pfoutz (Pfoutz) was injured when her car collided with an object lying in the middle of the freeway. Pfoutz sued State Farm Mutual Automobile Insurance Company (State Farm) for coverage under the insurance policy and Missouri’s uninsured motorist statute, alleging that her injury resulted from the negligent operation of an unidentified motor vehicle. A United States Magistrate 1 granted summary judgment, for State Farm, finding that a jury could only speculate as to whether the occurrence was caused by negligence.
