The plaintiffs in the Court below, on the trial of this cause, shewed in evidence, a patent from the United States to An-sel Sawyer, for the land in controversy. This patent is dated, the twenty-ninth of February, eighteen hundred and thirty-six, and recites, that Ho-gillis-i-nihaw, one of the Creek tribe of Indians, by virtue of the treaty made the twenty-fourth day of March, eighteen hundred and thirty-two, became entitled, out of the lands ceded to the United States, by the said treaty, to the tract of land, which is the subject of this suit, which, with the approbation of the President of…
