MEMORANDUM

FRANK GRAY, Jr., Chief Judge.

This action was brought by L.O.C. Industries, Inc. (hereinafter referred to as L.O. C.), for a preliminary and permanent injunction to restrain the United States from conducting a second examination of L.O.C.’s books and records, and to require the United States to return monies seized by levy on L.O.C.’s bank account, pursuant to a jeopardy termination of L.O.C.’s tax year. On February 4,1976, a hearing was held in this court on L.O.C’s motion for a temporary restraining order to preclude the Government from proceeding with its second examination. 1…
