Appeal by the plaintiff, Ferris J. Meigs, from a judgment of the ■Supreme Court in favor of the defendant, entered in the office of the cleric of the county of Franklin on the 22d day of October, 1898, upon the decision of the court rendered after a trial at the St. Lawrence Special Term dismissing the complaint.

Parker, P. J.:
The action is ejectment to recover from the defendant the possession of about 58of acres of land.
Such land is wild and uncultivated, situated in Franklin county, within the limits of the Forest Preserve, and it is claimed that the defendant, as Comptroller of the State, is in the actual possession thereof, and that this action may -be maintained against him by reason of the provisions of section 13'of chapter 711, Laws of 1893.
