Tbe plaintiffs, Dobson & Whitley, on or before the 12th day of August, 1900, were the owners of a grist mill in the county of McDowell, and on that day it was destroyed by fire. They had insured this property in three different companies to the amount of $1,800, which amount was paid them by said insurance companies. The plaintiffs, Dobson & Whitley, commenced this action against the defendant on the 1st day of December, 1900, and in their complaint, filed at Sjnfing Term, 1901 (May 15, 1901), they allege that said property was burned by the negligence of the defendant, and that they were…
