—Appeal by the defendant from a judgment of the Supreme Court, Kings County (Schneier, J.), rendered January 6, 1986, convicting him of sodomy in the first degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

Contrary to the defendant’s contention, the court properly denied his request for a missing witness charge. The defendant waited until both sides had rested to make his request to charge. The untimely request put the People at a disadvantage and was thus correctly denied (see, People v Gonzalez, 68 NY2d 424; People v Waldron, 154 AD2d 635). In any…
