This case involves a commercial real estate lease granting the plaintiff lessee, Hawthorne’s, Inc. (Hawthorne’s), both a right of first refusal and an option to purchase the premises at a fixed price. Hawthorne’s brought suit in the Superior Court against the lessor, Warrenton Realty, Inc. (Warrenton), and subsequent owners of the premises, following its unsuccessful attempt to exercise its option to purchase.
