On March 12, 1964, a two-count indictment was returned against Rosecrans and five codefendants. The first count charged that on September 1, 1963, and continuing to the date of the return of the indictment, they, in violation of Title 18 U.S.C. § 241, did conspire “with each other and with divers other persons to the grand jury unknown” to injure, oppress, threaten and intimidate one Donald Godfrey, a negro citizen of the United States, and other persons similarly situated, in the free exercise and enjoyment of a right secured to them by the Constitution of the…
