This is an action by a buyer against the sellers for damages for fraudulent representations allegedly occurring in connection with the sale of a retail business and certain franchise agree ments. The jury returned a verdict for the buyer of $60,000 actual and $7,500 punitive damages. Sellers appeal from the judgment rendered thereon.
At trial much of the evidence was sharply disputed. Our narrative necessarily will be in the aspect most favorable to the party prevailing in the trial court, the plaintiff. We relate the background first.
