This case is here for the second time, Boyle v. State, 97 Ind. 322. One of the questions now argued by appellant’s counsel was decided adversely to the appellant on the former appeal, and to that decision we adhere, not simply on the ground that it is the law of the case, but for the further reason that we believe the point was well decided.
