On March 10, 1995, an undercover police investigator purchased an aluminum packet of cocaine from an individual he identified as defendant. Defendant was later arrested and charged in a two-count indictment with criminal sale of a controlled substance in the third degree and criminal possession of a controlled substance in the third degree. Defendant ultimately pleaded guilty to the first count in the indictment charging criminal sale of a controlled substance in the third degree in satisfaction of the indictment and he agreed to waive his right to appeal.
