The court is here considering two eases which by order of the court have been consolidated, one appealed from the superior court of Creek county, state of Oklahoma, which is referred to as the Berryhill Case, No. 12227, and the other appealed from the district court of Creek county, which is referred to as the Gibbs Case and is numbered 12303 in this court. - On the 19th day of February, 1920,' M.
