Mr. Presiding Justice McBride

delivered the opinion of the court.

This was a trial of the right of property which resulted in a verdict and judgment for the plaintiff under the direction of the court, from which judgment the defendant prosecutes this appeal.

The appellant has assigned five errors hut in the view we take of this case it is only necessary to consider the second error, which is, “That the court erred in instructing the jury to return a verdict for the plaintiff.”
