This case comes to the Law Court on report. At the April Term, 1983, of the Superior Court in Penobscot County the Grand Jury indicted Muriel Rand and Philip Henry for the crime of arson. At the same term, upon conclusion of the State’s evidence, the presiding Justice ordered a verdict of not guilty as to Rand.

The other respondent, Henry, filed a plea in abatement to the indictment, alleging as reasons for abatement the following:
