CALDWELL, Circuit Judge.

Samuel C. Nichols, the plaintiff in error, hereafter designated as the “defendant,” was indicted by the grand jury of the United States for the Eastern division of the Eastern district of Missouri for alleged violations of the internal revenue law. The indictment contained four counts, but the jury found the defendant guilty on the third count only; and the district attorney entered a nolle prosequi as to the other counts, which will not be further mentioned.
