For incidents occurring on October 21, 1996, James T. Smith (“Smith”) was charged with bank robbery by intimidation, 18 U.S.C. § 2113(a). At trial, Smith admitted to the facts of the bank robbery, but defended himself with the theory that his actions during the robbery did not constitute intimidation as required under the statute. A jury found Smith guilty, and he was sentenced to 210 months of imprisonment, followed by three years of supervised release. Smith appeals two of the district court’s rulings during trial.
