FLANIGAN, Judge.

On March 6, 1986, Leo W. Allstun, Jr., Juvenile Officer of the 32nd Judicial Circuit, filed, in the Juvenile Division of the Circuit Court of Bollinger County, a petition, based on § 211.444,1 seeking to terminate the parental rights of Richard with respect to his son Brandon, age 8.

The petition alleged that the mother, legal and actual custodian of the child, was Cynthia; that the “legal father,” Richard, “has consented in writing to the termination of his parental rights in the child and believes that the best interest of the child would be served if the child was available…
