Johnston, C. J.:

This was a mandamus proceeding to compel the board of county commissioners of Stanton, county, to designate the plaintiff, The Johnson State Bank, as the Stanton county depository. By agreement of the parties the- cause was tried by Hon. William H. Thompson as judge pro tern., the district judge being disqualified. From the judgment in favor of the plaintiff granting the peremptory writ of mandamus the defendants appeal.
