The declaration in this case counts on an appeal bond, and contains four counts.
The case may be briefly stated: On the 16th day of April, 1870, in the circuit court of Cook county, in a cause there pending wherein appellee was plaintiff, and one James H. McCausland was defendant, the jury returned a verdict for plaintiff for the sum of $1250, and on a motion for a new trial, the court was of opinion that the verdict was too high, and thereupon plaintiff offered to remit of the verdict the sum of $600, and upon that suggestion the court overruled the motion for a new trial.
