This is an appeal from the order of the court below-dismissing the exceptions filed to the order of that court dismissing the petition for a contest for the office of Commissioner for the Third Ward in Shaler Township, Allegheny County.

The Return Board made the following return:

Edward T. Bauman, Jr.......122 votes

Elmer Mertz................ 121 votes

It is argued by the contestants, 24 citizens and qualified electors of the Third Ward, that ballots marked Exhibits “1” and “2”, respectively, were improperly rejected by the Return Board. Exhibit “1” was excluded…
