OPINION
McGOWAN, Circuit Judge:
Plaintiff rail carriers challenge certain orders entered by the Interstate Commerce Commission in rate proceedings under the Interstate Commerce Act, 49 U.S.C. § Iff. Those proceedings are characterized by the Commission as involving “a situation which to our knowledge has not heretofore been presented for our consideration in a formal proceeding,” namely, the invocation of Section 15(7) of the Act to change a tariff by terminating a multiple-car rate. 1 The novelty of the issue has prompted the Commission to reformulate the burden of proof statutorily imposed…
