(dissenting)—This habeas corpus proceeding is instituted by W. H. Buckingham, who was tried and convicted of the crime of incest and was sentenced to a maximum term of life imprisonment at the state penitentiary.

Petitioner alleges that he was denied rights guaranteed to him by the Washington and United States constitutions, in that he was rushed to trial without time for his court-appointed counsel adequately to prepare his case.
