CARRAND, Circuit Judge.

[1] The plaintiff in error, hereafter called defendant, was convicted and sentenced upon the second count of an indictment which charged that defendant on February 21, 1918, in the county of Dent, state of Missouri, had willfully obstructed the recruiting and enlistment service of the United States, by then and there writing and causing to be printed and published in a newspaper called the Republican, printed and published at Salem, in said county and state, the editorial and article set forth in said count.
