In an action to recover damages for personal injuries, the plaintiff appeals from a judgment of the Supreme Court, Kings County (Rothenberg, J.), entered September 20, 2005, which, upon an order of the same court dated October 31, 2003 granting the motion of the defendant Fred Lane for summary judgment, is in favor of that defendant and against the plaintiff dismissing the complaint.
