—In an action, inter alia, to recover damages for breach of contract, the defendants appeal, as limited by their brief, from so much of an order of the Supreme Court, Nassau County (Warshawsky, J.), entered January 11, 2002, as granted that branch of the plaintiffs motion which was to substitute JCD Farms, Inc., as the party plaintiff in the action, and denied those branches of their cross motion which were for leave to amend their answers to include the defense of lack of capacity to sue, and to dismiss the complaint.
Ordered that the order is affirmed insofar as appealed from, with costs.
