This case requires the court to determine the applicability of the Federal Tort Claims Act, 28 U.S.C. § 1346(b) (“FTCA”) to an active Navy seaman injured on base while working off duty in a civilian capacity. Clarence Alden Seals was a naval seaman with the rank of AK2. While off duty, he worked at his Naval Air base for a civilian government contractor.
