This was an action of trover by E. P. Bedd & Company against W. A. Lathem & Sons, for the recovery of five bales of cotton. Each of these firms ran a mercantile store and each had an account against either Henry or Ethel McClure, or against them both jointly. The defendants also ran a warehouse in which the cotton had been stored by the McClures in the fall of 1920. It was contended by the defendants that they received it from the McClures in pledge.
