The Assistant Vice-Chancellor:

The bill in this cause is filed, to enforce a contract made by the defendant, for the purchase of a lot of land in the city of New-York. The complainants offered the same for sale, under a power in the will of their testator. The lot was struck off to the defendant, a deposite paid, and the usual memorandum of the auctioneer signed. Two leading objections are taken to the title, and upon the ground of these, performance is refused.
