When the writ was served upon the trustee in this case, he had in his hands a sum of money and a quantity of goods, which were the proceeds of sales of goods which the defendant delivered to him, in October or November, 1843. The delivery of the goods was ac*168companied with, directions to sell the same, and to pass-, the avails to the credit of Edward Griffith, who was represented by the defendant to have been his surety, and entitled to an indemnity.
