On October 16, 1963, the plaintiff, an infant suing by his next friend, filed his Motion for Judgment against the defendant, also an infant, for damages alleged to have resulted from the defendant’s negligent operation of a motor vehicle in which the plaintiff was a passenger. The action was filed by a non-resident attorney who associated a local counsel. Within several days, service of process was had upon a member of the defendant’s family at his usual place of abode, he then being in another jurisdiction as a member of the Armed Forces.
