Plaintiff in error appeals from a conviction in the district court of Kiowa county on a charge of adultery and resulting sentence to pay a fine of $500 and be confined in the state reformatory at Granite for a term of one year.

The Attorney General has filed a motion asking that this court modify said judgment and sentence to a fine of $500 and the payment of court costs by the plaintiff in error, and for grounds of his motion says:

“That on or about the 3d day of July, 1924, one S. H. Arnold and wife, Billie Arnold, were living in Cordell in Washita county; that the said S. H. Arnold was 25…
