The object of the suit was to set aside a certain deed of gift made by J. Thornton Cropp on the 13th of January, 1877, whereby he conveyed to a trustee for the benefit of his wife, the said Ann M. Cropp, all his estatej consisting of a tract of land containing 160 acres, and personalty of the value of several thousand dollars. The principal, if not the only real .question in the case,'is whether at the time the deed of the 13th of January, 1877, ivas executed, the grantor, J. Thornton Cropp, was sane and mentally competent-to make the deed. The hill alleges that the deed is void on three grounds — viz., (1) Because it was not duly acknowledged; that is, because Goode, by whom the acknowledgment, ivas taken, had ceased to he a justice of the peace; (2)' because the deed was never delivered; and (3) because the grantor at the time was insane.
